International Recognition of Trusts Act, 2017 comes into force May 1, 2018

The OBA has been advised by the Attorney General that the Convention on the Law Applicable to Trusts and on their Recognition, done at The Hague on July 1, 1985 (the Hague Trust Convention), and set out in Schedule 1 to the International Recognition of Trusts Act, 2017 will come into force on May 1, 2018. A notice will be published in the Ontario Gazette setting out the date when the convention begins applying in Ontario so that there is an official record of this event.

OBA Members will recall that the International Recognition of Trusts Act, 2017, was passed into law as Schedule 7 of the government's omnibus style Burden Reduction Act, 2017, which also included schedules relating to:

  • International Choice of Court Agreements Convention Act, 2017
  • International Commercial Arbitration Act, 2017
  • International Electronic Communications Convention Act, 2017
  • International Sale of Goods Act Amendments
