SCJ Update - July 7

The Superior Court of Justice issued an Amendment Notice today. The Notice amends the Chief Justice Court Order Suspending Residential Evictions so that residential evictions are now suspended until the end of the calendar month in which the state of emergency is terminated, unless the court orders otherwise.

Consolidated Notice to the Profession and Public Regarding the Small Claims Court

The SCJ has revised its Notice Regarding the Suspension of Small Claims Court Operations. Effective June 2, the Small Claims Court will begin scheduling remote settlement conferences in non-urgent matters where certain conditions, listed in the Notice, are met. The Notice also includes instructions for how to proceed with scheduling a settlement conference.

The OBA has been working closely with Ontario courts to ensure that more matters are available to be conducted remotely during the emergency period.

SCJ Update June 29

June 29: The SCJ released a Notice to the Profession this afternoon regarding the Divisional Court. The Divisional Court will not resume in-person hearings on July 6, 2020 and will continue to hear matters remotely until further notice.

Small Claims Court: May 4 – Update

Since March 16, 2020, sittings of the Ontario Small Claims Court were suspended until further notice. The Small Claims Court has now announced that it will hear urgent motions and urgent garnishment hearings by telephone or videoconference.
