In Vincent v. Blake, Cassels & Graydon LLP, the Ontario Superior Court found that only a trial can determine whether a drafting solicitor owed a duty of care to a beneficiary under a will to ensure a correct valuation in the testator’s estate freeze.

You won’t find "phantom income" in the Income Tax Act. It is more of a legal term of art. I would hazard a guess that most practitioners do not consider this type of income when drafting trust documents.
