Brown Bag Lunch - April 16, 2019

The OBA’s Brown Bag Lunch (BBL) on April 16, 2019 had a lively discussion on a variety of estates law and trust topics. A summary is found below.

The BBL started off with a discussion in respect of the recent provincial budget impacting estates. If approved, effective January 2020, the estate administration tax will be eliminated for taxable estates with assets of $50,000 or less and will be reduced by $250 for larger estates. 

The second topic considered when it was appropriate for a lawyer to act as an estate trustee. The case of Law Society of Ontario v. Dinnen, 2019 ONLSTH 33 was examined to emphasize that a conflict of interest can arise where a drafting lawyer decided to represent the estate in a will challenge.
