Of Supreme Interest: Supreme Court Declares "When in Doubt, Report!"

The authors discuss the decision in Castonguay Blasting Ltd. v. Ontario (Environment), where the SCC considered the narrowly stated purpose provision of the Environmental Protection Act against the broad statutory definition of "adverse effect" in relation to a blasting incident that sent rock debris flying. The authors conclude with some observations about their experience with the Spreme Court Advocacy Institute, which simulates the experience of appearing in the SCC.
