Changes to the Canadian Trademarks Act Coming into Force on June 17, 2019: 5 things brand owners should know

On June 17, 2019, amendments to the Canadian Trademarks Act will be coming into force. These amendments were initially proposed in 2014 in Bill C-31. A few of the important changes are highlighted below:

1. Filing Fees

The government trademark application filing fees are changing from a single fee to a per class fee system based on the applied-for goods and services, and registration fees will be eliminated. The fees for an application filed before June 17 are $250 if filed online ($300 if filed by paper) at the application stage and $200 upon registration. After June 17, the government application fees will be $330 for the first class of goods or services plus $100 for each additional class, and the registration fee will also be eliminated.

Practice point: Brand owners intending to file multi-class applications in Canada should consider filing before June 17 to take advantage of the lower government fees.
