As Ontario and other provinces continue to regulate the offer and operation of franchises, disputes and litigation in the area continue to rise, with more decisions being rendered that address the franchise relationship and interpret provincial franchise laws, including Ontario's Arthur Wishart Act. This publication is intended to give both commercial and litigation lawyers who do not regularly practise in the area and those new to this practice area the necessary tools to understand the statutory framework, deal with common areas for franchise disputes, and understand franchise litigation claims and tactics.
