On behalf of the Ontario Bar Association (“OBA”), we are pleased to provide you with comments on the draft regulations (collectively, the “Draft Regulations”) that propose changes to the general Regulation 909 under the Ontario Pension Benefits Act (the “PBA Regulations”).

As promised, I am writing to provide more detail on one of the issues of growing concern, namely, the “status notice” and “status hearing” procedures outlined in Rule 48.14 of the Rules of Civil Procedure.

In the spring of 2010, the OBA and the Ministry of the Attorney General (“MAG”) exchanged correspondence on Ontario’s bonding requirements for estate trustees.
