On February 4, 2020, the OBA Health Law Section collaborated with the Constitutional, Civil Liberties and Human Rights Law Section in hosting “Key Constitutional and Human Rights in Health Law & Practice” at the OBA Institute. This article recaps some of the highlights of the event.

  1. Living and Dying with the Charter

The first panel discussed the developing legal landscape of the right to medical assistance in dying (MAiD) and related topics, where Charter rights of patients collide with those of health care providers.

The panel discussion was moderated by Deina Warren (associate director, legal affairs, Canadian Council of Christian Charities). Presenters included Daphne Jarvis (Borden Ladner Gervais LLP), Sally Bean (ethicist and policy advisor, Sunnybrook Health Sciences Centre), Derek Ross (Christian Legal Fellowship), Daphne Gilbert (associate professor, University of Ottawa Faculty of Law), and Colin Johnston (Lenczner Slaght), who discussed recent developments in the law governing MAiD and conscientious objectors, including the following recent cases:
