SCJ Toronto: COVID-19 Notice to the Profession Updated re Timelines for Civil Motion Forms, Requirement of Affidavits of Service to be Updated to CaseLines and More

The following updates have been made to the Toronto Region COVID-19 notice to the profession:

  • Paragraphs C.1.5 and C.2.3.c. now provide that the Civil Motion Confirmation Form is to be emailed to the court by 2:00 p.m. five (5) days prior to the hearing, excluding weekends and holidays. In the case of an abandoned motion where the responding party is seeking costs, the confirmation form must be sent by 10:00 a.m. four (4) days prior to the hearing. Motion materials must be uploaded into CaseLines at least three (3) days in advance of the hearing.
  • Section C provides that, in both short and long motions before Associate Judges, all affidavits of service must be uploaded into CaseLines.
  • Paragraphs C.1.4 and C.2.5 are amended to clarify unavailability of Rule 50.13 case conferences in actions governed by the Construction Act.
  • Section E regarding Commercial and Estate List matters has been updated to reflect current practices.
  • Section H – Procedures for Actions Governed by the Construction Act is amended to provide greater clarity on procedures for matters brought before judges and associate judges, including reorganization of existing provisions for ease of reference, a revised filing procedure for submitting urgent motions in writing, clarification on the correct court file in which motions should be brought, clarification on requirements for specific motions, and linking a revised fiat and vacating order form in new paragraphs H.4.1.b and H.4.1.c.
