Yuan V. Matsuura, 2022 ONSC 45: Fence Disputes in the City of Toronto

SUMMARY

A recent appeal from a judgment of the Small Claims Court raised an interesting question as to how fence disputes are to be resolved in the City of Toronto, although it left the answer to this question to be determined at a later date.

HISTORY

Mr. Yuan purchased a home beside Ms. Matsuura. The fence between the properties became a source of conflict.

The deputy judge finally found that although the fence was in good repair and did not need to be replaced – the gaps in the boards had led to conflict – so replacement was a good idea. She ordered that the cost be shared (among a few other minor orders).
