Responsive Justification and Sufficiency of Reasons: Mattar v The National Dental Examining Board of Canada

Background

This is a judicial review of two decisions of the National Dental Examining Board. The Board has three pathways for dentists to be accredited. The pathway relevant to this case is graduation from an “unaccredited” dentistry program and an Equivalency Assessment Process, which requires candidates to pass three assessments relating to knowledge, clinical judgment, and clinical skills.

Irinie Mattar was licensed to practice dentistry in Egypt and came to Canada in 2007. Ms. Mattar passed the knowledge test and the clinical judgment test of the Equivalency Assessment Process. However, she failed the clinical skills test on all three of her attempts.
