ON - SCC Releases Decision in Indalex Limited (Re)

The Supreme Court of Canada released its highly anticipated decision in Indalex Limited (Re). Key holdings are:

  • The Supreme Court of Canada unanimously affirmed the priority of a court ordered charge in insolvency proceedings over the interests of provincial pension claims.
  • The Supreme Court of Canada affirmed the broad scope of a provincial statutory deemed trust over the full value of a pension wind up deficiency.

ON - FSCO Updates Family Law Forms

Effective January 1, 2013, the Financial Services Commission of Ontario has updated its family law forms. For FSCO Family Law Forms 4A, 4B, 4C, 4D, 4E and 1A, plan administrators may continue to use the 2012 forms until June 30, 2013. Along with the forms, FSCO includes links to a User Guide and Qs & As.
