Updates from Toronto Bankruptcy Court Registrar’s Committee on September 18, 2018

  • November 13, 2018

Scheduling matters in December:

For the month of December 2018, the Bankruptcy Masters will be dedicating additional resources to in writing / chambers matters and taxations.

As well, the Court will be focussed on scheduling short bankrupts’ applications for discharge.  Lastly, please note that the last day for the hearing of motions for this month will be December 18, 2018.

Notwithstanding the aforementioned, the Bankruptcy Masters will make every effort to accommodate cases that are urgent, and stakeholders are asked to contact the Bankruptcy Court office to obtain further direction regarding the scheduling of such urgent matters.

Approval of Solicitor’s Bills of Costs:

The Registrars are rejecting Bills of Costs where there is a deficiency in the information provided, particularly in describing the work performed to justify the fee charged:

  • Docket and time descriptions MUST be included with the Bill of Costs – not general “to all matters…” that does not permit the registrars to evaluate whether the time spent was valid.
  • Solicitor accounts MUST be signed by the Trustee (and Inspectors where applicable) on each bill of costs no photocopied generic trustee signature.
  • Do NOT submit a bill of costs for three years that bundles together 12 separate accounts.  If you bill a trustee monthly for a year, you will be providing 12 Bills of Costs, each with a $50 fee.
