“Game on: Esports and Video Game Law Primer”: Program Review

On March 22, 2021, the OBA Entertainment, Media and Communications Law Section offered a CPD program titled “Game On: Esports and Video Game Law Primer” hosted by Section Executive member Sal Lo Iacono (associate, TD Securities).

This program was the second in a series of esports-focused programs hosted by the Section. The panel featured two experienced lawyers in the space, Jolan Storch and Evan Kubes, who spoke about what it means to be a lawyer in this rapidly evolving industry. Evan Kubes is the president and co-founder of MKM Group, a law firm dedicated exclusively to esports and content creators. Jolan Storch is the founder of Bold. Counsel, where she acts as a legal consultant for clients such as OverActive Media, a global esports company.

The discussion began by reflecting on the many areas of law the esports ecosystem engages. From intellectual property, corporate law, immigration, and everything in between, the nimble and fast-growing nature of the industry makes it ripe for legal planning opportunities. Features often associated with traditional sports such as brand sponsorships, partnerships, and player organizations are just as relevant in the esports industry and players are increasingly needing legal support in these areas.
