POSITION SUMMARY

Within CHEO, and operating with a semi-independent mandate, is the Better Outcomes Registry and Network (BORN). BORN is Ontario's prescribed perinatal, newborn and child registry with the role of facilitating quality care for families across the province. BORN, acting as a prescribed registry, collects, interprets, shares and rigorously protects high-quality data essential to the understanding of and planning for better perinatal, newborn and child health in the province.
CHEO is seeking a Legal Counsel and Privacy Officer to join their legal team in support of the functions and strategies being developed and implemented at BORN.
You will be accountable for supporting the overall legal and privacy framework at BORN, while providing guidance on a broad and diverse mix of legal disciplines encompassing regulatory (compliance), corporate and commercial law and other matters as required by the management of BORN. This role reports to the General Counsel and Chief Privacy Officer of CHEO and requires a high degree of visibility and presence across the organization, with demonstrated skills in negotiation and execution.
Key functions for the Legal Counsel and Privacy Officer will include the following, all of which are in the context of providing direct support to BORN while doing so in the greater context of CHEO:
• Act as the legal counsel and privacy law advisor to the senior management of BORN on a multitude of issues and topics. This entails ensuring the needs of BORN are being met while being consistent with the principles and processes in place at CHEO.
• Actively contribute to the development and implementation of a proactive legal framework, enabling opportunities to be realized for value-added legal service and guidance.
• Provide strategic and operational leadership regarding legal opportunities and challenges, strategic planning, and risk management.
• Continue to provide support and advice to the BORN privacy program, establishing policies, protocols, and appropriate internal controls for privacy matters.
• Liaise and interact with CHEO privacy professionals and with the Office of the Information and Privacy Commissioner as needed
• Continue to advance key stakeholder relationships with colleagues, hospital executives, and staff, and external partners to ensure collaboration, as well as alignment with the changing provincial health care landscape.
• Negotiate, design, draft and/or review legal agreements, documents and contracts and either leads or assists with the negotiations with counterparties where clauses, stipulations or requirements are unacceptable.
• Work closely with team members to create a service and performance delivery culture.


EXPERIENCE
The successful candidate will have at seven to ten years of legal experience in a complex, regulated environment, ideally combined with relevant privacy and health law experience. In addition to possessing a law degree and being a member in good standing with the Law Society of Ontario, the Candidate will be a self-starter, an inspiring leader and engaged team player. This is an influential role that requires someone with excellent legal and business acumen who is proficient with managing relevant legal and privacy matters in in a complex, multi-stakeholder environment. The successful Candidate will have the transformational ability to implement leading practices and provide advice that reinforces corporate accountability and best governance standards. In addition, they will have the ideal opportunity to be a vocal and visible advocate of excellence, while contributing to both strategic and operational legal leadership across the organization.

QUALIFICATIONS

• Police Record Check (PRC) (Essential).
• Minimum of 7 to 10 years legal experience required.
• Privacy and health law experience in a complex care delivery environment or comparable experience in a complex regulated environment.
• Strong technical legal ability demonstrated through experience managing relevant legal and privacy matters in comparable environments.
• Ability to create, compose and edit institutional policies and other written materials together with strong communication skills.
• Highly developed legal and policy analysis skills.
• Demonstrated negotiating skills.
• Proven complex contract drafting and review capabilities.
• Bilingualism – French/English is an asset.


Bilingualism (French/English) will be validated by a language proficiency assessment conducted by a third-party provider. Candidates will be required to meet the minimum linguistic profile prior to the date of hire.
