York U. applied for a Norwich order to obtain the identity of the the author(s) of an allegedly defamatory and widely distributed e-mail. York had already successfully applied for the IP address related to the Google email account used in the communication. The court used the factors determined by the Ontario CA review of Norwich orders (GEA Group AG v. Flex-N-Gate Corporation, 2009 ONCA 619) to assess whether the order should be granted.
