The defendants are former employees and suppliers of the plaintiff. The plaintiff retained an investigative agency to examine the activities of the defendants in establishing a competing business. During discovery, the defendants received the investigative report and became aware that the investigator had obtained the defendants' Bell Canada telephone records without their consent or court order and that the investigator had made audio and video recordings secretly and without permission. In a counterclaim, the defendants allege invasion of privacy, trespass and breach of confidentiality.
