The defendants seeks an order to protect the confidentiality and secrecy of certain information, similar to that in their litigation in Federal Court. The plaintiff objects because their agreement in the discovery plan did not restrict disclosure and production of information in any way, and that the defendant had already undertaken to produce the documents. The court notes that the timing coincides with when the confidentiality issue was raised in Federal Court and is not unreasonable. Discovery plans can evolve as circumstances change.
