This submission is made by the Business Law Section of the Ontario Bar Association (the “OBA”) in response to the request for comments published on July 29, 2011 (the “Request for Comments”) with respect to the Proposed Instrument.

We are pleased with the work that has been done to address the issues raised by the Canadian Bar Association (“CBA”) on the Federation of Law Societies’ Model Code of Professional Conduct.

We are writing on behalf of an Ontario Bar Association ("OBA") working group that has been established to address the growing issues surrounding court and tribunal appointed assessors who are the subject of inappropriate complaints to their professional colleges.

On behalf of the Ontario Bar Association (“OBA”), we are pleased to provide you with comments on the draft regulations (collectively, the “Draft Regulations”) that propose changes to the general Regulation 909 under the Ontario Pension Benefits Act (the “PBA Regulations”).

As promised, I am writing to provide more detail on one of the issues of growing concern, namely, the “status notice” and “status hearing” procedures outlined in Rule 48.14 of the Rules of Civil Procedure.
