This submission is made by the Business Law Section of the Ontario Bar Association (the “OBA”) in response to the request for comments published on November 11, 2011 (the “Request for Comments”) with respect to the Consultation Notice.

As the people on the front lines of the justice system, OBA members understand the crucial importance of ensuring access to justice to protect legitimate legal rights while avoiding the chill on public participation and drain on public resources that ill-motivated law suits can exact.

This submission is made by the Business Law Section of the Ontario Bar Association (the “OBA”) in response to the request for comments published on November 25, 2011 (the “Request for Comments”) with respect to the Proposed Amendments.

The OBA appreciates the opportunity to provide advice to the Government on reforming the law of cash collateral, an important initiative that we believe will both reduce costs for government and further Ontario’s Open for Business and Open Ontario initiatives.

In anticipation that there may be future opportunities to make changes to the OBCA, the OBCR and the OBCA Forms Regulation, we set out below a comprehensive list.

The Ontario Bar Association appreciates the opportunity to provide comments to the Financial Services Commission of Ontario (“FSCO”) on the proposed Family Law Forms which will support the new regime for the valuation and settlement of pensions upon marriage breakdown.

The Ontario Bar Association (―OBA‖) appreciates the opportunity to comment on the Draft Aboriginal Consultation Guide for preparing a Renewable Energy Approval (REA) Application (the ―Guidelines‖).

The Ontario Bar Association (“OBA”) appreciates the opportunity to comment on the Draft Third Party Processes Policy (the “Policy” or the “Draft Policy”) produced by the College of Physicians and Surgeons of Ontario (“CPSO”).

Pursuant to an order of the Honourable Associate Chief Justice of Ontario, dated May 4, 2011, the OBA was appointed Amicus Curiae for the purpose of rendering assistance to the court on the meaning and scope of rule 20 of the Rules of Civil Procedure.
