There is a new Notice to the Public and the Profession from the Tax Court of Canada. All in-person sittings of the Tax Court scheduled between March 15, 2021 and March 26, 2021 have been cancelled. A limited number of sittings are set to resume in Toronto, Montreal and Vancouver between March 29, 2021 and July 16, 2021. Conference calls scheduled for March 15, 2021 will not be affected by the changes.

Chief Justice Eugene P. Rossiter issued a Notice to the Profession and the Public regarding the remote commissioning of affidavits. Due to the COVID-19 pandemic, the Tax Court of Canada will accept affidavits that are sworn or affirmed remotely using a method accepted by the Superior Court of the province where the person administering the affidavit is located. The affidavit must state that it was commissioned remotely. This practice will remain in effect until at least June 30, 2021.

Chief Justice Eugene P. Rossiter has issued a Notice to the Public and the Profession regarding the cancellation of sittings for the Tax Court of Canada. Due to the increased prevalence of Covid-19 in cities where the Tax Court of Canada holds proceedings, the Chief Justice has cancelled all in-person sittings scheduled between November 30, 2020 to January 15, 2021. However, select in-person appeals in Montréal that will conclude on November 30 and December 1, 2020 will proceed as scheduled.

The Tax Court released COVID-19: Recommended Preventive Measures, which serves as a guide in the resumption of in-person court operations. This guide applies equally to matters at the Federal Court of Appeal and the Court Martial Appeal Court of Canada.

The Court posted a Notice to Parties for In-Person Hearings providing guidance regarding the measures and directives in place for hearings.

The Tax Court of Canada and its Registry offices will remain closed for business until further notice.
